Passengers are carried subject to our BOOKING AND PASSAGE TERMS AND CONDITIONS and the conditions of other carriers concerned. Passengers should read the BOOKING AND PASSAGE TERMS AND CONDITIONS outlined in the relevant cruise line brochures. You can view or request a copy of any of our brochures via this site. The terms of our BOOKING AND PASSAGE TERMS AND CONDITIONS shall prevail to the extent of any inconsistency with these WEBSITE TERMS & CONDITIONS.

Limitation of Liability

Subject to any responsibilities implied by law and which cannot be excluded, we are not liable to you for any losses, damages, liabilities, claims and expenses (including but not limited to legal costs and defence or settlement costs) whatsoever arising out of or referable to material on our websites, whether in contract, to or including negligence, statute or otherwise. Liability of Carnival plc for a breach of a condition or warranty implied by law or otherwise, and which cannot be excluded, is limited to the supply of the goods or services again or the cash equivalent.

Acceptance of and Changes to our Website Terms & Conditions

You acknowledge and accept that your use of our websites indicates your acceptance of these TERMS & CONDITIONS and of our PRIVACY POLICY. We reserve any rights not expressly granted in these TERMS & CONDITIONS. These are the current TERMS & CONDITIONS and replace any other terms or conditions previously published. If we decide to change our TERMS & CONDITIONS, we will post these changes on this page.

1. Academy Program Terms and Conditions 

BY REGISTERING FOR THE ACADEMY PROGRAM YOU ACKNOWLEDGE AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS STATED HEREIN. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THIS SITE. THIS SECTION APPLIES TO ALL REGISTERED MEMBERS OF  PRINCESS ACADEMY. THE ACADEMY PROGRAM IS LIMITED TO QUALIFYING TRAVEL AGENTS AND QUALIFYING TRAVEL AGENCIES (SEE BELOW FOR DEFINITIONS) WHO RESIDE IN AUSTRALIA AND NEW ZEALAND.

2. Definitions

 Academy” shall mean Princess Academy.

"Academy Program Terms and Conditions" shall mean the Terms and Conditions as specified by Company, and as amended from time to time in its sole discretion, that govern the operation of the Academy Program.

"Academy Program" or "Program" shall mean the program pursuant to which Company shall make available to Qualifying Travel Agents the opportunity to achieve a certain Rank (or Level) by performing and reporting Qualifying Activities and the opportunity to accept certain Offers associated with each Rank.

"Academy Rank List" shall mean a list of the currently available Ranks or Levels from which Qualifying Travel Agents may achieve.

"Academy Rank System" shall mean the system adopted by Company for assigning Ranks (Levels) to the Qualifying Activities performed by Qualifying Travel Agents.

"Account" shall mean the account for the registered Travel Agent on the www.wlcl.com.au and www.wlcl.co.nz website and the Travel Agent Dashboard Account that provides an accounting of each Travel Agent's Rank achieved.

"Company" shall mean Carnival plc trading as “World’s Leading Cruise Lines”.

"Course" shall mean an educational course, whether online or otherwise, sponsored by Company, a certain number of which must be taken by a Qualifying Travel Agent in a particular calendar year in order for the Qualifying Travel Agent to attain a Rank and eligibility for any Offers from Company in connection with the Program (except as specified herein).

"Offer" shall mean promotional or educational opportunities for Qualifying Travel Agents made available, as part of the Program from time to time, by Company in its sole discretion.

"Owner" shall mean the participant whose user profile has an "Agent Type" flag of "Owner" for the Qualifying Travel Agency on www.wlcl.com.au or www.wlcl.co.nz.

Producing” shall mean a Qualifying Travel Agency that has the required number of active bookings created within the last three hundred and sixty five (365) days. These bookings must be either deposited or paid in full to count toward this requirement. The required number of bookings shall be four (4) for Princess Cruise Lines. Where a booking is created through a wholesaler, the secondary travel agency must be nominated on the booking in POLAR Online for both parties to be credited as Producing.

"Qualifying Activities" shall mean those activities identified by Company that Travel Agents may perform to achieve Ranks, including but not limited to Courses designated by Company.

"Qualifying Travel Agency" shall mean those Travel Agencies that have registered on www.wlcl.com.au or www.wlcl.co.nz and are operating as a travel agency selling Company's cruises and travel packages as of the time of registration and Offer acceptance.

"Qualifying Travel Agent" shall mean a person employed as a Travel Agent of a Qualifying Travel Agency who meets the eligibility requirements set forth in the Academy Program Terms and Conditions at the time of registration and acceptance of any Offer. For purposes of these Terms and Conditions, a "Qualifying Travel Agency" may be referred to herein as a "Qualifying Travel Agent," unless otherwise stated.

"Rank" shall mean the Level that a Qualifying Travel Agent may achieve by performing and reporting Qualifying Activities in accordance with the Academy Program Terms and Conditions.

"Refresher Course" shall mean an educational course, whether online or otherwise, sponsored by Company, a certain number of which must be taken by a Qualifying Travel Agent in a particular calendar year in order for the Qualifying Travel Agent to retain his/her Rank and eligibility for Offers from Company in connection with the Program (except as specified herein) and to be considered as having Active Status.

3. Program Eligibility

Any Qualifying Travel Agent and a Qualifying Travel Agency shall be eligible to participate in the Program by registering as outlined herein.

A Qualifying Travel Agent will be registered in the Program by: (i) registering online in the Academy section of www.wlcl.com.au or www.wlcl.co.nz and (ii) agreeing to these Program Terms and Conditions. The Qualifying Travel Agent will be assigned a member number on registration. When a Qualifying Travel Agency registers, the Owner must enrol in the Academy by adding their member number to their www.wlcl.com.au or www.wlcl.co.nz account. Qualifying Travel Agents are responsible for keeping their www.wlcl.com.au or www.wlcl.co.nz registration information, including but not limited to member number, accurate, complete and current in order to maintain their status as Qualifying Travel Agents.

If a Qualifying Travel Agency is disqualified from the Program, all Qualifying Travel Agents (including the Owner) associated with the Qualifying Travel Agency will be immediately disqualified from participation in the Program and shall have no right to achieve any Rank or accept any Offer of Program participation.

A Qualifying Travel Agency may deactivate a Qualifying Travel Agent's Account, in which case the Qualifying Travel Agent shall be disqualified from the Program. To the extent that any participant is no longer a Qualifying Travel Agent, he/she will be immediately disqualified from participation in the Program and shall have no right to achieve any Rank or accept any Offer of Program participation.

Where a Qualifying Travel Agent changes employment from one Qualifying Travel Agency to an alternate Qualifying Travel Agency, the Qualifying Travel Agent may request that the Company transfer his/her member number and Academy history to the alternate Qualifying Travel Agency. The Company has sole discretion on whether to accept any requests for transfer. All decisions are final. No Account, Rank or Offer may be transferred between Qualifying Travel Agents.

4. Program Terms and Conditions

Participating in the Program and all of the associated Ranks or Offers available as part of this Program are offered at the discretion of the Company. Company reserves the right to modify, terminate, withdraw the Terms and Conditions, Academy Rank List, Academy Rank System, Offers or any other aspects of the Program, in whole or in part, at any time, with or without notice, even though such changes may affect the value of the Rank or Offers already accumulated. Qualifying Travel Agents and Qualifying Travel Agencies are responsible for periodically reviewing the Academy Program Terms and Conditions in order to understand their rights and responsibilities under the Program. A Qualifying Travel Agent's or Qualifying Travel Agency's continued use of the Program, following the posting of conspicuous notice of any modification, will indicate his/her acceptance of any modification to the Terms hereof. Company may terminate the Academy Program at any time. A Qualifying Travel Agent or Qualifying Travel Agency should not rely upon the continued availability of the Program or any Rank or Offers accumulated in connection therewith. Qualifying Travel Agents or Qualifying Travel Agencies may contact Company with any questions they may have about the Program Terms and Conditions or the Program generally.

5. Academy Rank System
Qualifying Travel Agents may achieve a Rank, or Level, by performing the required number of Qualifying Activities or by other means as Company may permit in its sole discretion. The Ranks and number of Qualifying Activities in order to achieve each Rank are currently as follows (but may be amended from time to time in Company's sole discretion):

6. Qualifying Activities
In order to achieve a Rank for Princess Academy, a Qualifying Travel Agent must perform Qualifying Activities on www.wlcl.com.au or www.wlcl.co.nz or by other means as Company may permit in its sole discretion, including but not limited to, taking Courses designated by Company. To pass a Course, a Qualifying Travel Agent must obtain a score of 70 percent or better. In the event that a Qualifying Travel Agent does not pass a Course, he/she may re-take the failed Course until passed. A list of Qualifying Activities can be found by checking the “Curriculum” link on their Academy Dashboard. 

7. Academy Rank List and Offers for Qualifying Travel Agents
A Qualifying Travel Agent is eligible to receive the following Offers once they have achieved the corresponding Rank as follows if they work for a Producing Qualified Travel Agency at the time of Offer acceptance. Company, at its sole discretion, may also provide any Offer to a Qualifying Travel Agent who does not work for a Producing Qualified Travel Agency at the time of Offer acceptance. Providing an Offer to a Qualified Travel Agent who does not work for a Producing Qualified Travel Agency at the time of Offer acceptance does not entitle Qualified Travel Agent to any other Offer nor create any obligation for Company whatsoever.

  • Digital Commodore Marketing Kit (available for download from the Academy site)
  • Eligible to apply for an Academy Graduation Cruise Course Offer when offer is made (limited in availability) (as set forth in section 9 below)

Offers and Rank achieved do not constitute property and may not be exchanged for cash, auctioned or assigned or transferred by a Qualifying Travel Agent or Qualifying Travel Agency or by operation of law to any person. Qualifying Travel Agents and Qualifying Travel Agencies are responsible for keeping track of any Offers. No extensions or other exchanges will be allowed for any Offer. The Offers structure is subject to modification, termination or limitation at any time, with or without notice, at Company's sole discretion, and Company expressly reserves the right to establish additional means of accruing Ranks and Offers, to delete any or all of the currently recognised means of accruing Ranks and Offers, to exclude specific types of accrual there from or to make Ranks and Offers selectively available to certain Program members based upon factors in its sole discretion.

For Qualifying Travel Agents (not Qualifying Travel Agencies) retention of Rank is subject to completing required Refresher Courses or achieving the next Rank, per calendar year, as set forth in Section 10 below. Qualifying Activities will be credited to the member number submitted at the time of undertaking such activity. Ranks and Offers available via the Program may not be split between member numbers, Accounts or any individuals.

8. Academy Rank List and Offers for Producing Qualifying Travel Agency
A Qualifying Travel Agency will achieve the highest Rank that any one of its Qualifying Travel Agents achieves via the Program. In connection therewith, the Producing Qualifying Travel Agency is eligible to receive:

  • Princess Cruises Captain’s Circle Gold level membership onboard benefits for Qualifying Travel Agency. This benefit rewards the Owner of the Qualifying Travel Agency for encouraging their team to participate in Princess Academy. For Agencies that have achieved the rank of First Officer, whenever the Owner of the Qualifying Travel Agency cruises with Princess Cruise Lines, the Owner of the Qualifying Travel Agency will receive the same onboard Gold Level Captain’s Circle Benefits as set forth at https://book.princess.com/captaincircle/jsp/memberShipBenefitsForProspect.jsp#Gold (excludes off-ship benefits)

Staff Captain:

  • Princess Cruises Captain’s Circle Ruby level membership onboard benefits for Qualifying Travel Agency. This benefit rewards the Owner of the Qualifying Travel Agency for encouraging their team to participate in Princess Academy. For Agencies that have achieved the rank of Staff Captain, whenever the Owner of the Qualifying Travel Agency cruises with Princess Cruise Lines, the Owner of the Qualifying Travel Agency will receive the same onboard Ruby Level Captain’s Circle Benefits as set forth at https://book.princess.com/captaincircle/jsp/memberShipBenefitsForProspect.jsp#Ruby (excludes off-ship benefits)

Captain:

  • Princess Cruises Captain’s Circle Platinum level membership onboard benefits for Qualifying Travel Agency. This benefit rewards the Owner of the Qualifying Travel Agency for encouraging their team to participate in Princess Academy. For Agencies that have achieved the level of Captain, whenever the Owner of the Qualifying Travel Agency cruises with Princess Cruise Lines, the Owner of the Qualifying Travel Agency will receive the same onboard Platinum Level Captain’s Circle Benefits as set forth at https://book.princess.com/captaincircle/jsp/memberShipBenefitsForProspect.jsp#Platinum (excludes off-ship benefits)

Commodore:

  • Princess Cruises Captain’s Circle Elite level membership onboard benefits for Qualifying Travel Agency. This benefit rewards the Owner of the Qualifying Travel Agency for encouraging their team to participate in Princess Academy. For Agencies that have achieved the rank of Commodore, whenever the Owner of the Qualifying Travel Agency cruises with Princess Cruise Lines, the Owner of the Qualifying Travel Agency will receive the same onboard Elite Level Captain’s Circle Benefits as set forth at https://book.princess.com/captaincircle/jsp/memberShipBenefitsForProspect.jsp#Elite (excludes off-ship benefits)
  • Digital Commodore Marketing Kit. Upon completing the Graduation Course, Commodores and Owners of Commodore Rank Qualifying Travel Agencies will have access to the Commodore Marketing Kit consisting of specially-designed marketing materials that feature the Princess Academy Certified Experts logo.

9. The "Graduation Cruise Course" Offer.
Qualifying Travel Agents who achieve Commodore Rank and maintain an active status in the Academy in which they achieved Commodore Rank (by completing all relevant Refresher Courses as set out in section 10 below) may be eligible for a maximum of one Graduation Cruise Course Offer. Qualifying Travel Agencies are not eligible for a Graduation Cruise Course Offer.

Graduation Cruise Course Offers are announced from time to time at Company’s sole discretion via notification emails and Academy dashboard messages. The number of Graduation Cruise Courses offered at any one time is at Company's sole discretion and is subject to limited availability and restrictions. IT IS LIKELY THAT THE NUMBER OF AGENTS WHO ACHIEVE COMMODORE RANK WILL BE MORE THAN THE NUMBER OF GRADUATION CRUISE COURSE PLACES AVAILABLE. GRADUATION CRUISE COURSES WILL BE ALLOCATED AT COMPANY’S SOLE DISCRETION. IT IS RECOMMENDED THAT A QUALIFYING TRAVEL AGENT LOOK FOR THE ANNOUNCEMENTS FOR GRADUATION CRUISE COURSE AVAILABILITY AND RESPOND IMMEDIATELY IN ORDER TO GET THE BEST CHANCE OF SECURING PASSAGE ON A CRUISE. THIS OFFER DOES NOT GUARANTEE PASSAGE ON A GRADUATION CRUISE COURSE.

All Graduation Cruise Courses must be taken during the time period specified; no alternative cruise dates are available other than as specifically set forth by Company and/or as ticketed.

Cabins on Graduation Cruise Course Offers are double occupancy, are available on a first-to-book basis, and are subject to limited availability.

A limited number of triple, quad or oceanview cabins on some Graduation Cruise Course cruises may be offered. Supplements will apply and will be advised in the FAQ’s document at time of booking.

The Qualifying Travel Agent and one (1) guest must travel on the same itinerary and occupy the same cabin on the same Graduation Cruise Course cruise. Qualifying Travel Agent and their guest may be required to (or guest's parent or legal guardian if guest is an eligible minor in his/her state/territory/province of residence) sign and return a cruise/publicity release as requested by Company.

A Graduation Cruise Course will require the Qualifying Travel Agent to take part in the following educational activities:

(1) meet with the Future Cruise Consultant and Circle Host/Hostess during the cruise;

(2) complete a questionnaire regarding onboard activities and services and return a copy of the completed questionnaire to their Qualifying Travel Agency;

(3) participate in a staff-guided Ship Tour during the cruise 

 

The Graduation Cruise Course Offer, or any unused portion of the Graduation Cruise Course Offer, is non-transferable, and cannot be substituted, redeemed or exchanged for cash.

ALL APPLICABLE FEDERAL, STATE, PROVINCIAL AND LOCAL TAXES (IF ANY) ON THE GRADUATION CRUISE COURSE OFFER OR ANY OTHER OFFER ARE THE SOLE RESPONSIBILITY OF QUALIFYING TRAVEL AGENT OR QUALIFYING TRAVEL AGENCY (INCLUDING, BUT NOT LIMITED TO, FRINGE BENEFITS TAX).

TRAVEL TO AND FROM EMBARKING OR DISEMBARKING PORTS IS NOT PROVIDED BY COMPANY AND IS THE SOLE RESPONSIBILITY OF QUALIFYING TRAVEL AGENT. All ground transportation, shore excursions fees, discretionary hotel and dining charges, meals in alternate dining venues, alcoholic beverages, boutique purchases, travel insurance and any other incidental costs or other expenses not specifically set forth herein are the sole responsibility of Qualifying Travel Agent.

If a Qualifying Travel Agent cancels his/her Graduation Cruise Course thirty (30) days or less from the date of departure, he/she agrees to be subject to the Program then in-effect Cancellation Policy, which includes forfeiture of Graduation Cruise Course Offer. If a Qualifying Travel Agent purchases paid upgrades or other add-ons (including air, transfers, or hotel packages), they are subject to applicable cancellation fees or expenses then in effect. Subject to the preceding paragraph, Graduation Cruise Courses are subject to the terms and conditions of the Company Booking and Passage Terms and Conditions.

The Company reserves the right to refuse to allow a Qualifying Travel Agent and/or his/her guest to take part in any or all aspects of the Graduation Cruise Course if the Company determines in its absolute discretion that a Qualifying Travel Agent and/or his/her guest are not in the mental or physical condition necessary to be able to safely participate in the cruise, or if they pose a risk to the safety and wellbeing of any other passenger.

Once the cruise has commenced, if a Qualifying Travel Agent and/or his/her guest seriously affects the safety, well-being or enjoyment of themselves or any other person onboard, the Captain has the right to confine, sedate or disembark the guest. In such cases, the Company is not responsible for any expenses including travel expenses to return home.

The Company has the right to cancel a Graduation Cruise Course at its sole discretion.

10. Refresher Courses

In order for a Qualifying Travel Agent to maintain a Rank (Level) and be eligible for Offers, a Qualifying Travel Agent must comply with all requirements of the Program, as set forth herein, including but not limited to taking the Refresher Courses as set forth herein or achieving the next Rank. The Refresher Course requirement does not apply to the calendar year in which the Travel Agent initially earned a Rank. The requirement of taking the annual Refresher Courses or achieving the next Rank does not apply to Qualifying Travel Agencies. In order for a Qualifying Travel Agent to maintain a Rank during any calendar year, the Qualifying Travel Agent is required to complete a certain number of Refresher Courses within the designated time period during each applicable calendar year or achieve the next Rank. Refresher Courses do not count towards advancing to the next Rank. If a Qualifying Travel Agent fails to take the required number of Refresher Courses in any particular calendar year or achieve the next Rank, he/she shall be deemed "inactive" in the Program.

To pass a Refresher Course, a Qualifying Travel Agent must obtain a score of 70 percent or better as determined by Company in its sole discretion. In the event that a Qualifying Travel Agent does not pass a Refresher Course, he/she may re-take the failed Refresher Course until passed.

11. Viewing Your “Dashboard Account”

Qualifying Travel Agents are responsible for ensuring that the Rank and Qualifying Activities completed are properly reflected in their Dashboard Account. Refer to Section 4 on how a Qualifying Travel Agent may contact Company if the Qualifying Travel Agent believes his/her Program Account does not accurately reflect the correct Account status. Any claim for Rank not credited accurately must be received by Company within six (6) months of the date of claimed accrual of such Rank.

Company shall have no liability for any printing, production, typographical, mechanical or other errors in the Dashboard Account distributed by Company or www.wlcl.com.au or www.wlcl.co.nz, for any delay or failure to credit Rank to your account or for any failure to provide the Dashboard Account as outlined herein. Company reserves the right to invalidate a Rank or Offer from an account if it determines that such were improperly credited to such account or obtained fraudulently. Company reserves the right to require proof of accrual of Rank and Company reserves the right to delay the processing of any Offer without notice to Qualifying Travel Agent or Qualifying Travel Agency, in order to assure compliance with the Terms and Conditions outlined herein.

Qualifying Travel Agents are responsible for maintaining the confidentiality of their account and password and for restricting access to his/her computer and/or other electronic devices and Qualifying Travel Agents agree to accept responsibility for all activities that occur under his/her account or password. Without limiting any other remedies, Company may suspend or terminate a Qualifying Travel Agent's or Qualifying Travel Agency’s account if Company suspects that he/she/it has engaged in fraudulent activity in connection with this Program. Participation in the Program is subject to the Terms and Conditions, as well as policies and procedures that Company may adopt or modify from time to time. Any failure to abide by the Terms and Conditions or any policies or procedures implemented by Company, any conduct detrimental to Company, or any misrepresentation or fraudulent activities in connection with this Program, including but not limited to registering fraudulent travel agencies for the purpose of securing benefits hereunder, may result, in addition to any rights or remedies available to Company in law or equity, in the termination of membership in the Program, as well as forfeiture of Rank and Offers accrued to date and any other offers earned in connection therewith, in Company's sole discretion.

12. Release

By participating in the Program, each participant hereby agrees to release and hold harmless Company, www.wlcl.com.au or www.wlcl.co.nz and their respective affiliates and their directors, officers, employees, agents and other representatives from any and all claims for damage, injury, death, loss or other liability that may arise out of or in connection with the participant's participation in the Program, Participant's acceptance or use of any Rank or Offer or any error, defect, failed performance or other malfunction of, or misuse of, any Rank or Offer.
By participating in the Program, Qualifying Travel Agent and his/her guest, hereby agree that such person's name, likeness, image and/or voice (including photograph, film and/or recording of the same) may be used for the advertising, marketing and promotion of Company in any and all media now known or hereinafter developed without territorial or time limitations and without any additional compensation.

13. Program Administration

Company and www.wlcl.com.au or www.wlcl.co.nz shall have full power and authority to interpret the Program Terms and Conditions and make all Program decisions. All participants shall be bound by all such determinations of Company and/or www.wlcl.com.au or www.wlcl.co.nz.

14. Limitation on Liability
COMPANY AND WWW.WLCL.COM.AU AND WWW.WLCL.CO.NZ WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION LOST PROFITS OR LOST SAVINGS), WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, THAT ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH (A) ANY USE OF THE PROGRAM, (B) ANY FAILURE OR DELAY BY US IN CONNECTION WITH THE PROGRAM (INCLUDING WITHOUT LIMITATION THE USE OF OR INABILITY TO USE ANY COMPONENT OF THIS PROGRAM), OR (C) THE PERFORMANCE OR NON- PERFORMANCE BY COMPANY, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorised access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.

THE LIMITATIONS ABOVE ARE SUBJECT TO ANY MANDATORY PROVISIONS OF THE AUSTRALIAN CONSUMER LAW AND MAY BE LIMITED IN ITS APPLICATION TO YOU.

15. Disclaimer of Warranties

COMPANY MAKES NO WARRANTY OF ANY KIND REGARDING THE PROGRAM, WHICH IS PROVIDED ON AN "AS IS" BASIS. COMPANY EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY THAT ITS PROGRAM WILL BE ERROR-FREE. COMPANY FURTHER DISCLAIMS ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS AND TIMELINESS OF ANY CONTENT OR INFORMATION DISTRIBUTED WITH RESPECT TO THE PROGRAM. COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS, INCLUDING IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE. THIS WARRANTY DISCLAIMER IS SUBJECT TO ANY MANDATORY PROVISIONS OF THE AUSTRALIAN CONSUMER LAW AND MAY BE LIMITED IN ITS APPLICABILITY TO YOU.

16. Taxes
Please check with your tax advisor to see if there are any tax implications to you with regard to this Program. If there are any taxes, the Qualifying Travel Agent or Qualifying Travel Agency agrees to be solely responsible.

17. Acts Beyond Company Control
The failure of Company or www.wlcl.com.au and www.wlcl.co.nz to comply with the Terms and Conditions because of an act of God, war, fire, riot, terrorism, earthquake, actions of Federal, State or Local governmental authorities or for any other reason beyond the reasonable control of Company or www.wlcl.com.au and www.wlcl.co.nz, shall not be deemed a breach of this Agreement. In the event of any event of force majeure, Company shall have the right to terminate this Agreement by giving notice with no further liability to any Qualifying Travel Agent.

18. Dispute Resolution
This Policy shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any action at law or in equity arising out of or relating to use of this Policy shall be pursued only in New South Wales, and Agent hereby consents and submits to this jurisdiction. AGENT FURTHER AGREES THAT ANY DISPUTE OR CLAIM AGAINST THE COMPANY SHALL BE BROUGHT BY AGENT INDIVIDUALLY AND NOT ON BEHALF OF ANY OTHERS.

19. No Waiver
If Company fails to act with respect to your breach or anyone else's breach on any occasion, Company is not waiving its right to act with respect to future or similar breaches.

20. Captions
The headings in these Terms and Conditions are for your convenience and reference. These headings do not limit or affect these Terms and Conditions.

21. Complete Agreement
These Terms, together with the terms and conditions of www.wlcl.com.au and www.wlcl.co.nz, make up the entire agreement between all Qualifying Travel Agents and the Company relating to the Program, and replace any prior understandings or agreements (whether oral or written) regarding the Program. If a court finds any of these Terms and Conditions to be unenforceable or invalid, that Term and Condition will be enforced to the fullest extent permitted by applicable law and the other Terms and Conditions will remain valid and enforceable. If there is any conflict between these Terms and Conditions and the terms and conditions of www.wlcl.com.au and www.wlcl.co.nz, these Terms and Conditions shall govern.

Princess Cruises Travel Agent Rate Booking Tool

TRAVEL AGENT REDUCED RATES PROGRAM ("Program") TERMS AND CONDITIONS

THE PROGRAM IS LIMITED TO QUALIFIED TRAVEL AGENCIES AND QUALIFIED TRAVEL AGENTS (AS DEFINED BELOW) in Australia and New Zealand.

Definitions:

"Company" shall mean Carnival plc t/as Princess Cruises ("Princess").

"Deposited Booking" shall mean an agency booking where the deposit payment has been received by Princess. Refer to the Booking and Passage Terms and Conditions at www.princess.com.au for all payment and cancellation terms that govern deposit payments.

"Sailed Booking" shall mean an agency booking where the voyage has departed and the booking has been paid in full.

"Qualifying Booking" shall mean a Deposited or Sailed booking as defined herein.

"Qualifying Travel Agency" or "Agency" shall mean those travel agencies that have registered on www.onesourcecruises.com.au or www.onesourcecruises.co.nz and are operating as a travel agency selling Company's cruises and travel packages as of the time of registration and booking of a Travel Agent Reduced Rate ("TARR").

"Qualifying Travel Agent" or "Agent" shall mean a person employed as a travel agent of a Qualifying Travel Agency who meets the eligibility requirements set forth in the Travel Agent Reduced Rate Program Terms and Conditions at the time of registration and booking of any travel at a TARR. Agent must be in good standing with a Qualified Travel Agency at the time all documents are submitted for booking a TARR sailing and must be a travel agent with the Agency at the time trip is taken. For purposes of these Terms and Conditions, a "Qualifying Travel Agency" may be referred to herein as a "Qualifying Travel Agent," unless otherwise stated.

Program Eligibility: A Qualifying Travel Agent and a Qualifying Travel Agency shall be eligible to participate in the Program by registering as outlined herein. Qualifying Travel Agent agrees that at least one (1) passenger on a TARR booking must be a Qualified Travel Agent, with no exceptions. Further Qualifying Travel Agent agrees at least one (1) of the passengers on a TARR booking must be at least the age of 21 at the time of sailing for all Princess Ships except when travelling on the Dawn Princess, Sea Princess and Sun Princess, in which case the Qualifying Travel Agent agrees that he/she is at least the age of 18 at the time of sailing. Online booking is limited to Agencies and Agents that reside in either Australia or New Zealand. To register, all Agents must go to www.wlcl.com.au (AU) or www.wlcl.co.nz (NZ) and register the Agency by submitting the required information. By making and confirming a booking at a Travel Agent Reduced Rate, the Agency and Agent agree to abide by these Program Terms and Conditions, Princess Cruises Booking and Passage Terms and Conditions available at www.princess.com, and Princess Cruise Lines Privacy Policy available at www.princess.com.au, as applicable. Except as otherwise expressly provided, in the event of any conflict between the applicable Program Terms and the Booking and Passage Terms and Conditions, the terms of the Booking and Passage Terms and Conditions shall control.

Eligibility For Reduced Rates: Any Qualifying Travel Agent meeting eligibility requirements may book Travel Agent Reduced Rates to sail on select Princess Cruises voyages only, subject to availability. In order for an agent to qualify for TARR sailings, its Agency must have at least FOUR (4) Qualifying Bookings booked through the Agency in the twelve (12) months prior to when the TARR rate is booked. The agency will be eligible, subject to availability, for one (1) TARR booking for every FOUR (4) Qualifying Bookings. A Qualifying Booking is either: 1) a Deposited booking or 2) a Sailed booking. TARR bookings do not qualify as a Qualifying Booking for eligibility purposes. An Agency may have a maximum of fifty (50) TARR bookings confirmed at a time.

Booking Procedures: Agents residing in either Australia or New Zealand may book a TARR sailing by booking online at www.wlcl.com.au (AU) or www.wlcl.co.nz (NZ). Payment for a TARR booking is due in full via credit card at the time of booking.

At any point in time prior to or during the cruise, Company reserves the right to require Agent to provide documentation supporting that Agent is a Qualified Travel Agent and is eligible for travel on the TARR booking, in Company's sole discretion. Qualified Travel Agent may be required to show they hold a current and valid POLAR Online login which matches the name on the booking and have uploaded any necessary supporting documentation to their account at www.wlcl.com.au (AU) or www.wlcl.co.nz (NZ). If Agent fails to provide the required identification and information, the booking may be re-booked at then applicable rate on the date of re-booking. In the event a TARR booking is re-booked at the then applicable rate, Agent may be required to pay any difference in fare between the TARR booking and the new booking immediately.

Any Agent or Agency booking a cruise under this Program represents that he or she is an adult over the age of 18 and authorised by all other persons for whom a booking is made to accept and agree on their behalves to all the terms and conditions set forth in the Booking and Passage Terms and Conditions.

General Conditions: TARR booking confirmations will be sent to the Agency's fax or email address provided at registration. All cabin assignments are final, cabin change requests are not allowed. Bookings are non-transferable. Approval and confirmation of a TARR booking does not guarantee travel. Company reserves the right to cancel any booked cruise with or without advance notice if Agent, or guests, fail to abide by these Terms and Conditions, including eligibility requirements, or if assigned space is required for a commercial customer or due to cancellation of a sailing. Please refer to the Booking and Passage Terms and Conditions found at www.princess.com.au.

Ground transportation, gratuities and all other expenses not specified herein, including but not limited to shore excursion fees, meals in alternate dining venues, alcoholic beverages, boutique purchases, photographs, travel insurance or travel protection and any medical expenses incurred while on the ship or transiting to/from the ship are the sole responsibility of Agent. Cruise Plus Hotel packages and Shore Excursions can be purchased at the standard passenger rate. Agent is solely responsible for obtaining all necessary travel documents, as well as for obtaining travel insurance or travel protection if desired. Transfers may be available for purchase at the standard rate. Agents will not be paid a commission for any TARR bookings. Agents and their guests must pay any onboard bill in full upon disembarkation of their voyage. All TARR bookings are subject to the Booking and Passage Terms and Conditions, then in effect.

Participation in the Program and all of the associated Travel Agent Reduced Rates or any other benefits offered by Company as part of this Program are offered at the discretion of the Company. Company reserves the right to modify, terminate, or withdraw the Terms and Conditions, rates, or any other benefit or aspect of the Program, in whole or in part, at any time, with or without notice.

Notwithstanding any other provision in any other contract or applicable terms, any fraud or material breach of these terms by Agent or Agency, or cancellation of Agency of its agency relationship with the Company gives Company the right to cancel all TARR bookings held by the Agency (and any Agent employed therewith) as well as all TARR privileges for the Agency and Agent, with no liability, including refund, payment or other compensation, to Agency or Agent. In the event a TARR booking is invalidated for any reason, and/or if Company determines that the Agent or Agency is not eligible for a TARR booking under these Terms & Conditions, Company may cancel the TARR booking, in Company's sole discretion, and the booking may be re-booked at then applicable rate on the date of re-booking. In the event a TARR booking is re-booked at the then applicable rate, Agent may be required to pay any difference in fare between the TARR booking and the new booking immediately.

By participating in this Program, Agency hereby agrees that it shall be jointly and severally liable for any violation of these Terms and Conditions by any Agent employed by it. By participating in this Program, Agency and Agent hereby agree to be jointly and severally responsible to reimburse Company immediately upon demand for any and all costs, expenses, liabilities of any kind incurred by Company for the breach of these Terms and Conditions by Agency and/or Agent.

Release: By participating in the Program, Agency and Agent hereby agree to release and hold harmless Company, www.wlcl.com.au (AU) or www.wlcl.co.nz (NZ) and their respective parents, subsidiaries, affiliates and their directors, officers, employees, agents and other representatives from any and all claims for damage, injury, death, loss or other liability that may arise out of or in connection with the Agency or Agent's participation in the Program and travel through TARR booking, except in the case and to the extent of the Company’s proven negligence.

Governing Law: Except as to claims governed by the Booking and Passage Terms and Conditions, any claim or dispute whatsoever arising out of or in connection with these Program Terms or Agency or Agent's participation in the Program, whether based on contract, tort, statutory, or other legal rights, or for any losses, damages or expenses, shall be governed by the laws of New South Wales, and the parties submit to the exclusive jurisdiction of the courts of that State.

No Waiver: If Company fails to act with respect to Agent's or Agency's breach or anyone else's breach on any occasion, Company is not waiving its right to act with respect to future or similar breaches.

Captions: The headings in these Terms are for your convenience and reference. These headings do not limit or affect these Terms.
